RULES AND CONDITIONS FOR PARTICIPATING IN PRIZE GAMES ON FACEBOOK AND INSTAGRAM FEELROOTY SOCIAL MEDIA PLATFORMS AND THE WEBSITE FEELROOTY.EU (later referred to as "Rules")
ARTICLE 1: ORGANIZER
The organizer of the prize games on the website and social media platforms FB and IG feelrooty (later referred to as "prize game") is BIOHACKING VITAL, d.o.o., Griže 129, Griže, 3302 Griže, registration number: 8947066000, VAT ID: 12255807 (later referred to as "organizer").
ARTICLE 2: PURPOSE OF THE PRIZE GAME AND GENERAL PROVISIONS
The purpose of the prize game is to promote the FeelRooty brand and products (dietary supplements and other sales programs). The prize games are not in any way connected with, sponsored, or supported by Meta Platforms, Inc. or Instagram LLC. All data and information will be provided only to the organizer. By participating in the prize games, it is considered that the participant fully accepts these Rules and the general conditions for participating in the prize game and fully agrees with them.
ARTICLE 3: DURATION OF THE PRIZE GAME
The prize game is conducted in the territory of European Union. The duration is defined in the prize game announcement on social media and website.
ARTICLE 4: PURCHASE IS NOT A CONDITION FOR PARTICIPATION IN THE PRIZE GAME
Purchase is not a condition for participation in the prize game. Participation is possible in two ways, described in more detail in Article 6.
ARTICLE 5: WHO CAN PARTICIPATE IN THE PRIZE GAME
The following can participate in the prize game:
- All adult persons (18+) with permanent residence in the European Union (they must be adults on the day the prize game begins). The condition for participation, defined on the website or in the prize game announcement on the Facebook and Instagram pages, must be met.
- Employees of the organizer and legal entities that in any way participate in the preparation of the prize game, are not allowed to participate in the prize game. Members of the draw commission are also not allowed to participate. If any of the before mentioned persons are drawn, the draw is considered invalid, and the prize is transferred to the reserve winner.
ARTICLE 6: HOW TO PARTICIPATE IN THE PRIZE GAME
Participation in the prize game is possible in two ways:
- METHOD – An individual makes a purchase of at least one product in the online store feelrooty.eu during the prize game period. Each purchase counts as one participation. An individual can make multiple purchases and thus participate multiple times in the prize game.
- METHOD – An individual sends a photo of their morning drink, along with their personal information: name, surname, address, phone number, email, to the e-mail address we@feelrooty.com, during the prize game period. Each photo with informations counts as one participation.
Only correct entries from the start to the end of the prize game will participate in the draw.
ARTICLE 7: PRIZE FUND
The prize fund consists of the prizes publicly defined in each prize game. The prize cannot be exchanged or requested in cash value or transferred to a third party. The organizer will pay income tax on all prizes exceeding EUR 42.00 for all winners. The winner cannot request a prize of higher amounts. The prize cannot be exchanged for cash. The prize is non-transferable.
ARTICLE 8: PRIZE DRAW PROCESS
After the end of the prize game, the draw is conducted by computer within 72 hours at the latest and will not be public. A two-member committee from the management of Biohacking Vital d.o.o. will participate in the draw.
ARTICLE 9: ANNOUNCEMENT OF WINNERS AND PRIZE COLLECTION
Within 72 hours after the draw, the organizer will contact the winner (regardless of the method of participation) via email, phone, or social media FB and IG, and ask for written consent to confirm participation in the prize game and collect the prize.
The prize will not be awarded if:
- The winner does not provide the correct and complete information to the organizer within 2 days of the draw notification;
- The winner does not meet the conditions defined in Article 5 of these Rules;
- The winner formally states that they renounce the prize. If a minor is drawn, the organizer will draw another prize recipient. The prize recipient is the person who provided their details on the letter, even if the letter was written by another person. If the winner does not collect the prize, the prize will remain unawarded. The winner will collect the prize in the manner determined by the organizer of the prize game. The organizer is not responsible if the winner cannot collect or use the prize due to circumstances beyond the organizer's control. The winner agrees to collect the prize in the manner determined by the organizer.
ARTICLE 10: TAX OBLIGATIONS
The prize from the prize game is taxed as other income according to item 3 of the third paragraph of Article 105 of the ZDoh-2, but only if its value exceeds EUR 42.00. If the prize value in this prize game exceeds the statutory limit of EUR 42.00, the organizer will withhold and pay the income tax advance for the winners.
ARTICLE 11: POSSIBILITY OF TERMINATING THE PRIZE GAME
The prize game can be terminated in case of circumstances for which the organizer or executor are not responsible, which could not be foreseen, avoided, or prevented (force majeure).
Participants will be informed about the termination of the prize game through a story post on the FB and IG social media platforms of FeelRooty. The moment the termination of the prize game is announced, it is considered that all participants have been informed.
ARTICLE 12: PROTECTION OF PERSONAL DATA
By entering the prize game, participants allow the organizer and executor, as controllers of personal data, to process all data provided in the prize game in accordance with the applicable Slovenian Personal Data Protection Act. Participants allow the organizer or executor, as the controller, to maintain, manage, and supervise the collected personal data records of individuals in accordance with the Personal Data Protection Act. The controller may also process the collected personal data for sending e-newsletters and other promotional material. For contact purposes, the individual allows the use of various communication channels, such as phone, personal mail, email. The controller may process participant data during the prize game, and store data about winners for 3 years from the prize award. During the management of personal data, the individual has the option to view, transcribe, copy, supplement, correct, block, and delete personal data in the data collection, in accordance with applicable regulations. Providing personal data is voluntary; if an individual does not wish to provide their data defined as mandatory for the implementation of this prize game to the controller, they will not be able to participate in the prize game. The organizer or executor will obtain personal data from participants who participated by purchase based on the written consent of the winner and will use them only for the purposes of sending the prize and withholding income tax advance.
ARTICLE 13: LIABILITY FOR ANY DAMAGE OR COSTS
The organizer assumes no responsibility for any damage resulting from this prize game or from collecting and using the prize, with which participants explicitly agree by joining this prize game. The organizer is not responsible for any network failures, communication errors, incomplete operation of the participant's email, or for entries that are incomplete, unclear, or not received. The organizer is not responsible for costs incurred for participating in the prize game or collecting the prize (transport costs, internet access costs, phone costs, or other possible costs).
ARTICLE 14: DISPUTES AND COMPLAINTS
All complaints and claims will be resolved by the organizer of the prize game. In the case of justified complaints, the organizer undertakes to resolve them as soon as possible and inform the participant. Possible disputes will be resolved by the competent court.
ARTICLE 15: FINAL PROVISIONS
Participants who participate in the prize game hereby expressly declare that they are familiar with the Rules and agree with them. The Rules will be available on the organizer's website, which the organizer also mentions in the description or posts on its FB and IG profiles; they take effect on the day the prize game begins. The organizer reserves the right to supplement and amend these Rules. The organizer undertakes to publish any changes or supplements to these Rules on the FeelRooty website.
